How to sue for unfair practices by employer

Hi in delhi high court i need to file a petition for seeking winding up of company which has not paid my salary dues for info already a petition was filed by vendor for outtanding payments OL was appointed but later it was withdrawn because of settlement please let me know who can help me and what should me average fee for this legal service

I would be happy to help. This petition would now not go before the Delhi high court. Instead it would have to be filed before the national company law tribunal. It should not be a problem and the fees would depend on large part upon the amount of money that is at stake for you. Thanks

You may file another petition for winding up of the company and the settlement entered into previously is not binding upon you. Various High Courts have held that a winding up petition by an employee is maintainable for recovery of unpaid salary dues. Therefore prima facie it seems that you may have a good case. As far as the fee is concerned, I would charge Rs. 12,500 for filing the petition and the fee per appearance would be Rs. 4,000. However, I would point out that it is completely negotiable.

You would need to consult a corporate litigation lawyer. However, have you considered approaching the labour court in this regard ? A winding petition may be a costly affair. Would need for information for further advice.

For recovery of your salary, a civil suit has to be filed and also a suit for winding up of the company can be filed in lieu non payment of debts by the company subject to certain conditions.
