How to recover money taken fraudulently by someone for giving job

A guy from Chennai took money from me offering a job. I gave 50,000 Rs and it has been 8 months since I gave the cash. I didn't get any job nor I got the money back. This guy works in a reputed corporate company as an engineer. So I trusted him. When I ask him to return the cash, he will tell a date and delay it with some stupid reasons. The only proof to show that I have gave him the money is the bank statement. The money was transferred to his personal bank account in his name. I have all the details of the guy. official and personal details. Please help me giving an advice how to proceed legally to get the money from him. I took loan to give that money.

You need to send him a legal notice and then you can either approach the civil court for specific performance for getting the money back. Your complaint more over relates to cheating you can also file a petition before the Police and if the police does'nt act you can file a petition for cheating in magistrate court.

As the transaction between you and the guy is not a legally enforceable transaction, the scope to file a civil suit pleading the same facts is having scant chance to succeed. Insted a criminal prosecution for cheating can be initiated against him for which he will be tried and punished by the criminal court. The court in such cases can impose fine and can direct the same to be given to you as compensation.
