Employeee broke Bond and vanished without intimation

So my employee had agreed to a Job agreement where he was serving a 9-month job contract on breaking of which there was a 2-month salary penalty. Suddenly without making any intimation he just vanished, without even serving any notice period (30 days). What all action can be taken against him. He has so far served just 3.5 months of his contract? Here one mistake on our side was, while we sent him the contract via email and got his written confirmation on the same, we did not actually get it signed on paper, will that be an issue?

Query perused. I am of the considered opinion that you should get a legal notice issued to the concerned employee for breach of contract and claim as per the provisions contained under the agreement. Contracts on email are valid and it was held by the Hon'ble Supreme court in one of the judgments that even arbitration can be enforced. For further consultancy and legal services you may contact us.

if the employee had accepted the terms and conditions via e-mail and you have such confirmation based on which you have been paying him salary and he served a period of 3.5 months, then it will be treated as a contract
