Does Local NDA require a stamp paper
26-Nov-2023 (In Corporate Law)
I need to sign an NDA with a consultant who will be working with us. During the course of his service, we will be sharing a lot of confidential data concerning third parties (our clients). Do we need to prepare the NDA on a stamp paper or company letter head should suffice to be legally binding?
yes you need to be registered all the documents what ever it's because it can't be a primary evidence once dispute comes in the case of documents are registered the government appointed authority is witnessed about your documents and it is having a top value documents otherwise it's just a paper and you need to take huge efforts to prove the documents
It doesn't matter whether you create Non Disclosure Agreement on Non-Judicial Stamp Paper by keeping two witnesses & getting it notarised or on Company's Letter-head or on mere simple paper. What matters is the presence of content of NDA & signatures of the Employer & Consultant. Presence of the ingredients of Contract is must for creating a Legal-Binding Contract.
