Can legal notice be send to company not giving relieving letter?

My company is holding me even if I have resigned and serving the notice period. I have informed them that I would be leaving by December as I have got a work visa as my notice period is only 45 days. Still, they are holding me for 3 months. Can a legal notice be sent to them? What should be done in this case?

Taking into consideration your the abive facts and our legal query.

A legal notice may be initiated against the company.
However it is always suggested to make sure that is no miss communication before resignation. As is normally does not happen.

Why are you seeking a relieving letter? As you say that as per the agreement you have served notice and also served the notice period then you send a letter to your company recording all these facts and say at the end that you are relieved from your service as per the agreement and the notice served by you. Attach a copy of the notice and your agreement. That shall be sufficient proof of your service at your new job. No need to get into any legal tussle you are safe.

Definitely You can send a notice stating that your retention/detention by the Company is illegal and in contravention of the Contract/ Terms and Conditions of employment with the Company. Would like to be of assistance in case further help is needed.
