Service center not able to fix problem in my bike can I claim refund

Hi, I am a owner of Bajaj Pulsat RS200 premium bike,I am facing the issue of heating near the seating area and escalated to Bajaj customer support,they serviced for 2 times and failed to resolve the issue,now I want to claim refund + compensation from Bajaj,thier customer support is not responding from 3 months,please advise next action and approx cost to file a case in consume court.

Dear Sir/Madam, it will purely depend upon rules and regulation i.e., terms and conditions of the your purchasing order form, if any manufacturing defect you have every right to get compensation as well as replacement if there is such condition is there in purchasing order form. Anyway, you have to issued a legal notice to the said Bajaj customer/Bajaji admn. and registered office immediately, already delayed, no more delay in this regard. It looks like there is a manufacturing defect in your bike simply because the company has tried to resolve the problem but they are not able to fix it. Hopefully your bike is under warranty period, if that is the case you can file a consumer court case for a alternative vehicle plus for deficiency of services, mental agony and compensation.
