RERA process in Bangalore if buyer wants cancellation of apartment

Hello Sir, we would like to know the process of cancellation under RERA act bangalore. If the buyer wants to cancel the booking of flat after the agreement is done and the property is still under construction.This property is registered under RERA act. What would be cancellation charges? As of now we had paid 22 lakhs. 15 lakhs is from bank and 7 lakhs from the buyer.

This entirely depends on what is agreed between your builder and the buyer at the time of booking a project. It is important to go through a "Agreement to sell " deed which will help clarify your concern. There will be a termination clause which needs to be abided by both the parties.

The matter of cancelling a flat booked by you is not a matter covered by RERA, instead it is a matter of the contract- agreement signed by you with the Builder. However, if cancellation is due to any fault or lapse by builder the terms about cancellation may not apply.

Karnataka real estate ( Regulations and redevelopment) Rules-2017 buyers may go back the project at any time, builder is bound by the law to return the money collected from the buyer within 45 days after deducting the amount of booking.
