08-May-2023 (In Consumer Court Law)
I paid an amount of Rs 4 lacs (10% of the total amount), as token money to builder for Phase 2 of under construction project in Dec 2015. Since last 1&1/2 yrs builder has not done buyer seller agreement and now I want my money back with interest for which he is reluctant. Tell me the legal remedy.

You have the option to choose between preferring a case before consumer forum or the real estate regulatory authority. In case you choose to go with the former, you'll have to file a case before the District Consumer Forum. however, before filing the case either with Consumer Court or RERA, you'll have to send a legal notice to the builder seeking full refund of the token money deposited with him together with interest.

Sir,
If your builder don't fallow buyer seller agreement and he do beyond of agreement or laps then you file a complain case in court for specific relief or back your payment with interest so you meet any advocate personally and file complain case in appropriate authority .

Prima facie, You may approach the consumer forum/commission against the builder. However a more specific reply/remedy can only be suggested after perusal of agreement with the builder and other relevant documents.
