Procedure in case carpenter not taking any action for damaged product

I Purchase leather sofa from Peach Tree on 26 Dec 16' worth Rs.54,000, not even 1 yr, the fabric got crack with broken lining. despite of our complaint, there is no action. I was inform to get replace with the fabric, but I do not trust their product anymore. I want the sofa to be replace with other (considering dep). now I am sick and tired of running after them, I am physically and mentally torture with their non response. please suggest what is the best remedy that I can undertake.

For which you need all the bills related to the same.
And you have to file the case within one year from the cause of action.

The sofa you bought is a defective product and should be covered under section2(f) of the consumer protection act, 1986 as follows:
(f) "defect" means any fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard which is required to be maintained by or under any law for the time being in force or under any contract, express or implied, or as is claimed by the trader in any manner whatsoever in relation to any goods;
Your query can certainly be converted into a complaint and filed before the district consumer forum under defective goods and defeciency in service.
You may claim compensation for loss caused+ mental agony + inferest(if any) upto a maximim limit of Rs. 20,00,000/- from the company and/or replacement of sofa.
But it is to be kept in mind that the complaint should be filed within a period of 2 years from accruing of cause of action. Hence it would be advisable to get in touch with an advocate for service of legal notice, at the earliest upon the company.
