Marriage Hall Money Refund Issue

This is to inform you that my father booked one marriage hall few months back for my elder brother marriage dated on 18th May. As you all know because of Corona everything is postponed and no function nothing can be possible for few months. So my father asked the marriage hall owner to refund the money which was given in advance but he is denying to give the amount and saying that you can book the same hall for any other date. So for his benefit we even find out few dates after consulting our pandit after which we told them two dates one in November and other in December 2020. Since everything is booked previously so he is denying to return the amount which i think is wrong in his part. So i want your help how to get my money back ??
Sir.. Please let me know if there has been any written contract between you and the owner of marriage hall.. If there is a contract, then we have to read it carefully that is there a FORCE MAJEAURE clause or not.
If there is no contract then there would be receipt of payments, on the basis of which you could approach court. But it would be better to give him a legal notice for refund. If he does not act, then you can approach the appropriate forum.

Hi, you can pursue the case legally. You can get a legal notice sent to him through an Advocate and accordingly pursue the case in a consumer forum or a civil court. Both the options are open for you.
