Is it mandatory to give legal notice or is it ok to file consumer case without sending legal notice

The Consumer Protection Act, 2019 encourages parties to resolve disputes amicably, and sending a legal notice gives the other party an opportunity to address the issue without going to court. However, if the consumer is unable to resolve the dispute through a legal notice or does not receive a satisfactory response, they can directly file a complaint with the Consumer Forum or the relevant Consumer Commission. In short, while sending a legal notice is a common practice and can help in resolving the issue at an early stage, you are not legally required to do so before filing a consumer case.

sending a legal notice before filing a consumer complaint is not mandatory but we should send legal notice for reference as a document that the notice to be replied or return , it's a highly recommended and practical step to allow the opposite party a chance to resolve the issue before resorting to legal action.
