HEALTH INSURER CANCELLED POLICY BUT PREMIUM PAID

my health insurer cancelled the policy for 1+ month during mid tenure despite premium paid and restores it after 1 month through endorsement , during lapsed timing the insured persons were on risk and meanwhile there was no claim arises eventually but the coverage lapsed by the insurer, can I seek a claim for the service default by the insurance company and ask for a compensation and mental agony through consumer court ?? is it legally correct? the ombudsman has denied request for comp

sure this is the perfect case of deficiency in service by the insurance company and in such a situation you may knock the door of the hon'ble district consumer commission concerned and suitable order in your favour.
