Delay in constructions from contractor asking for more money

I have made excess payment then the contract value ( including extra work we asked to do),in good faith I made even those payment which was suppose to be done after completion certificate. But suddenly after doing appx 80% of works, contractor latterly stop working at site ( working once a while ) and asking further money saying he has expend all money as material cost increased and paid to his labour in excess.I am tolerating till now and lost 8-10 Months along with money. kindly advise how I will move forward to get the work done immediately w/ further expending money as I already exhausted

Dear Sir,

Have you already executed the Agreement to Sale. If yes, what is the amount mentioned under consideration clause.

Have you paid the entire consideration.

You can file a case for cheating and MOFA i.e, Maharashtra Ownerships Flat Act.

This is clearly a case which comes in deficiency of service under Consumer Protection Act. You can issue legal notice to him by engaging advocate and if he doesn't complete work than file a consumer complaint in which you can ask for refund of money and compensation.
The case also comes under Specific Relief Act.

You can send him a notice first asking him to act as per your cobtract.
If he does not start with construction then you have multiple options but are time consuming.
Out of which one is non performance of contract, other you can approach consumer court.
