Claim rejected by Syska Gadget secure. What can i do?

My phone was stolen. While driving a car one person from left side told me that I am driving car on his leg. When I opened the left window other person was knocking right side window. I opened right side window . he said i can go. Meanwhile person from left side took the phone from the car . The phone was lying besides me. Syska says they pass the claim if phone was snatched from our hand. Are they right?
