Am I liable to pay my husband's debt

My husband has expired on August 22nd 2018. He has no assets. I have come to know through phone calls on his cell and email setup on his tab that he has a outstanding balance on a personal loan and 2 credit cards. I have not signed as a guarantor as I was not even aware of it. I am willing to submit the death certificate however, would not like to be harassed by the bank to pay.Please suggest.

No. You are not liable to your late husband's debts. If the banks call you and harass you for the payment, inform them about your husband's demise and if required, submit the death certificate. Despite this they continue to harass you,raise a complaint with RBI or banking ombudsman and request them to take action and if it also don't fetch results, file a police complaint against the banks and proceed further.

No need to worry on this aspect the banker will not do anything on you, it will remains bad debts for them when your husband doesn't have have any property on him and credit card outstanding balances are to be bared by cards holder only.

wife is not responsible for the debts of her husband. If there is a balance in the loan, it is for the defendants to recover the
amount through due process of law. The bank cannot take the law into their own hands to recover the loan. The woman is not a party to the transaction between the bank and her husband. Neither is she the guarantor for the loan. The bank and its
agents, including its representatives, are restrained from interfering with her.

Yes. You have responsibility to clear his dues. As a wife you have every right to get his fixed assets, variable assets like cash balances, fixed deposits, shares, insurance claims etc. Similarly you have obligation to clear his dues to the various banks, and others. File his death certificate at various concern and get all the benefits as a nominee.
