What to do if their is a dispute in dividing the property

My father passed away when i was 22 days old.after that we started living in my maternal grandfather's house.after few years my mother got into her second marriage but i still stayed with my nana and nani.my father had 4 brothers among which one of them expired before my father.Ther is a lot of property in ranchi on the name of my great grand father,my grandmother and my grandfather.But my grandfather dis owns me and is not ready to give me my share.I send him a lefgal notice through a lawyer one month ago but he did'nt even replied to that notice,though he received it.Now my lawyer is telling that we need to file partition suite and it will cost some % of the property value as court fee.But i am not capable of bearing that charge.So i want to know that if i don't have money then i will not be able to get my share?Because my grandfather is rich and he is using all his power and money against me to not give me my share.

The lawyer what he has stated inform his fees in the case if you willing to pay you may go through otherwise you may choose any other lawyer who can work on your condition but it should also always be in your mind that if the lawyer would not be competent to perform may damage your case. You can also think so that if you do not pay charges or the lawyer how do he exist. In other word you may understand it as "Agar Ghora Ghass se dosti karega to khayega Kaya" Regarding your case you have right on your share in the property but to get it legally you may file case before the appropriate forum. Well, Mr./Mrs. No doubt your question is looking complicated but is not so complicated. As you described earliar your lawyer has taken good steps.There is only remedy for this to file partition suit against them. Now the matter appear regarding court fees, you should have to enquir.... There is Fixed Court Fee of RS.250/only for the matter of partition suit. Plz be aware before taking action. Best of Luck.

Venerated Sir, As per the law of Code of Civil procedure you have right to file a suit as an indigent person but court fees has to be paid at the end of decree passed by the Court.
