Dear sir,nSir our father has gone missing today it has been 6 years can we file our case for civil death certificate today and what is the process of filing the case

hello as per your query I would suggest you to kindly wait for one more year as for the law after 7 years if a person is unhered it is Deemed to be dead and based on that you may proceed to file your civil case for for further assistants on this you may contact on the number register with the lawrato.

As you told that it has been 6 years since your father disappeared and you want to declare his civil debt by the court, then for this first of all it is necessary that any person who has been missing for 7 years has passed away. After that you will give notice of Section 80 CPC to the District Magistrate and then after 2 monthsyou will file a lawsuit in court
