in my case, my grandfather had done will (in the year 1981) and a sale deed (in the year 1985) of the whole property, both the things were registered and were drawn in favor of my uncle. and he has not done with dakhil kharij at that time and from the starting, my father and uncle are using the property in the half proportion. now my uncle is seeking for the whole share of the property including my father's share which has been mentioned in the registered will and sale deed but not done with the dakhil kharij. 1. so my query is weather my uncle is entitiled for the whole share of the property although it has not been done with dakhil kharij or if so then how ? 2. there is one more side shows that when my grand father died in year 1989 then, in 1991 my uncle has done with the compromise in the court of tahsildar mentioning that "we are two brothers and we will share the same property in equal proportionand or mein iss vasihat or bainame pe bal nahi dunga" is he entitled for all pro.
No your uncle is is not entitled for whole share.
