What can I do if a builder is creating nuisance in neighborhood?

12-Dec-2023 (In Civil Law)
Hi, I have a land adjoining a very reputed builder project. As my land adjoins the builder project he has created several water digs, wells and also spoiled the roads leading to my land. Water gets spilled continuously from those water wells which are made on his owned project and water has been piling up in my land and its adjoining areas. Also the trucks taking material on and off from the project has spoiled the road leading to my land. Please let me know what are my legal options against the builder to get these waterwells removed or sealed and also ask the builder to bring back the roads and my plot into its old original condition. I am very much upset as its directly impacting the resale value of my land and even closing my options to construct my own home there.

Dear questioner,in such case you can go to civil court and file a stay application. whatever wrong has been done to you, basically falls within the ambit of nuisance.you can file an injunction suit against him and get a STAY earlier. since,in india nuisance is not recognised in its true and independent form.the only remedy is to get a civil suit filed and fight it. remember one thing that you must have strong evidence to prove your case.
