What can be done if a Boutique in residential Flat is causing nuisance

My neighbor is running Boutique, she is a tenant.It is causing disturbance to me as it is my opposite flat. Her husband is a Security Body Guard to an Inspector General of Police.Pl. let me know where to lodge complaint, is it necessary to obtain permission for using residential flat to commercial.

Running boutique is commercial business so it required permission from competent authorities and also from your society otherwise it would become illegal. Whatever illegal act or omission caused by any person it amount to nuisance. Generally only service orientated professional practice is allowed in residential area like yoga classes, tuition, Advocate. In your she tenant so should enjoy the leasehold property for her enjoyment only but not using business. Further to convert building from residential building to commercial permission is required from local authorities. In my opinion you intiate civil action

you can file a suit for injunction restraining them to run the business without permission required with the local munsif judge of your jurisdiction you need to file the suit against the tenant and land lord also

Mere running a boutique is not abuse of power and also not a nuisance one more over for put up of boutique some permisions from govt. also be obtained. For what you want to lodge a complaint if it is cognizable offence it will be booked
