What are the essential steps while selling land and drawing agreement?

09-Sep-2023 (In Civil Law)
My grandfather sold a land in Jan-2015. The buyer is not paying the remaining money. The agreement to sell is unregisteted and does not contain any time clause by when the buyer can make the payment. What is the validity of the unregisterd agreement? When can i get free from the buyer's trap and sell the land to someone else? I am ready to return the advance money.

This section of the Registration Act specifically declares that if the agreement to sell is unregistered shall have no effect for the purpose of Section 53A of the Transfer of Property Act, 1882. It means that agreement to sell which is unregistered cannot be admissible as evidence. You can sell the land as the person is not the title holder as the execution of sale is not complete and in case of dispute you can pay the earnest amount back and sell the land.

You could have got that agreement registered. You did a mistake, for escaping from the taxes, plus now you want to sell to different person that very land which you sold to the 1st person. You are again and again committing offence rather a series of offence. Kindly try to take the money from the 1st customer itself..
