To withdraw the vakalatnama of an existing lawyer in a RERA matter, you simply need to file a “No Objection Certificate (NOC)” from the current advocate or a memo stating that the advocate is no longer representing you. If the advocate refuses to give NOC, you can file an application before the RERA Authority/Adjudicating Officer informing the forum that you are terminating the engagement and seeking permission to appoint a new lawyer. Once the forum records this, the new advocate can file a fresh vakalatnama and continue the case.

in case you have an advocate representing you then the vakalatnama cannot be removed but it can be changed by a new lawyer. so you can appoint a new lawyer and he can file a new vakalatnama on your behalf and the old one will be discarded automatically

To withdraw the vakalatnama of an existing lawyer in a pending RERA matter, the client simply needs to appoint a new counsel and file a fresh vakalatnama before the Authority. Once the new vakalatnama is filed, the earlier lawyer may file a No-Objection / discharge application or the Authority may record the change of counsel on its own. If the previous lawyer is not cooperating, the client can still proceed—RERA will accept the new vakalatnama and permit substitution of counsel after noting the request on record. There is no bar in continuing the case with a new advocate. Just ensure proper intimation is given during the next hearing.

Just make a fresh Vakalatnama and have it executed by the proposed lawyer who will be acting for you henceforth and take a no objection from the earlier lawyer preferably. However taking a no objection is not mandatory

Your written reply should be professional and factual. Clearly state that you deny the allegations in their entirety. Explain that you did not solicit the clients in question, as they contacted you first of their own volition. Further, clarify that any customer information or rate structures you referenced were obtained from publicly available sources, such as social media and the internet, and not from any confidential internal documents. Conclude this part by formally requesting that your employer provide specific evidence to support their broad accusations, including which clients were allegedly solicited and what specific confidential information was misused. It is critical that your reply avoids any admission of guilt, emotional language, or speculation. Do not share any details about your new company's internal strategies or operations. Importantly, do not sign any new documents or agree to a settlement under pressure. Before sending this response, it is strongly advised that you have it reviewed by an employment lawyer. Additionally, take steps to preserve all evidence that supports your position, such as records showing the clients initiated contact and examples of the publicly available information you used.
