To know the criteria for obc non creamy layer

My father is a clerk in L.I.C of india. Which is public sector undertaking. His gross income(as per his payslip) is 8 lacs p.a . Do i fall under obc non creamy layer? Many officers told i do fall but the clerk at the block office have denied to issue and forward my application to the higher authority as they see the income to be more than 6 lacs. What should i do? I am selected as a officer in a public sector bank and i need that certificate ASAP. also for future reference can i apply as obc for other government jobs?

As per your query I would like to inform you that while applying the Income/Wealth Test to determine creamy layer status of any candidate as given in Category-VI of the Schedule to the OM, income from the salaries and income from the agricultural land shall not be taken into account. It means that if income from salaries of the parents of any candidate is more than Rs. '2.s lakh per annum, income from agricultural land is more than Rs. 2.5 Jakh per annum> but income from other sources is less than Rs. 2.5 lakh per annum> the candidate shall not be treated to be falling in creamy layer on the basis of Income/Wealth Test provided his parent(s) do not possess wealth above the exemption limit as prescribed in the Wealth Tax Act for a period of three consecutive years.
If your parents do not belong to higher class jobs, if they have income less than 6 lakh(%% Got revised in 2013) from sources other than salaries and agriculture and their wealth is within the limit , then u are eligible for non creamy layer benefits.
Under the aforesaid circumstances you can apply job for OBC but cannot avail benefit of non creamy layer of OBC. Feel free to call me through lawrato.com.
