Terminated while being 5 months pregnant citing bad performance

08-Jun-2023 (In Civil Law)
I have been working with this company from 12th June 2017. I was put on a performance review on 24th April 2019. I informed by boss about my pregnancy verbally in April and she immediately said (verbally) but we are putting you on performance review of 3 months. I protested that I am pregnant and it will put me into stress but I was instead put through long sessions with my manager, AVP-HR and department head and forced to accept the review. My review began on 24th April and I was asked to resign on 15th May verbally. When I refused I was forced to sign my termination letter on 4th June. When I said the review was supposed to be of 3 months they said no, it was a wrong assumption we can cut it short also. What are the options for me now.

Query perused. I would advise you to issue a legal notice to the directors of the company for illegal termination to avoid the liability to pay the maternity benefits through a lawyer. Further a Law suit declaring the termination as null and void can be filed. For further consultancy and legal services you may contact us.

Hello mam I have perused your query. Here what you can do in these circumstances, you can file a complaint against the department for criminal intimidation under section 503 IPC causing you emotional distress and can seek damages as well. For further information feel free to contact me. Thank you

Hi You shall send them a legal notice asking them to reinstate you as an employee or else they shall be liable for the legal consequences. You can file a suit for wrongful termination of contract and also sue them for harassment. But first i would advice you to send a legal notice consisting all your averments. Regards, Madhav Nanda
