Tenant refuses to pay rent or vacate my property for over one year

My tenant is refusing to vacate my property or pay rent (for over one year now) and is demanding that I pay them to do so. The police refuses to file any case and dismiss this as a civil case. The tenants consist of mother-daughter duo and hence the police want to be careful dealing with them. And corona is not helping the cause either with courts closed down.

in this case firstly you have to issue a legal notice for non payment of rent and termination of lease under 106 of transfer of property act, then file a suit for recovery of possession and recovery of rent, if you file the petition at least you will be getting rent as the tenant cannot proceed with the case without paying the rent.

Issue a legal notice terminating the lease and file a suit for eviction and get them evicted through due process of law and also seek recovery of rent and mesne for holding over as a tenant at sufferance

Police are right they are in no way concerned to this as it is a civil matter. you have to approach jurisdictional court to evict them and to recover rent arrears first we should see your rent agreement, And what is the reason they are not paying reut before corona ? reply to us at prabhakaralawatgmaildotcom
