You must file a civil suit for declaration of title over the encroached area on the basis of title, recovery of possession and fixation of boundaries. You may file suit by scheduling the encroached area. Then identify the same with the help of an advocate commissioner appointed by the court with the aid of a surveyor and seek for recovery of possession of the said area and can seek for fixation of boundaries.

The query does not disclose the material facts. It is not clear how the Police interfered in a civil matter. Any how, you can always approach if there is dispute or that the neighbor has encroached upon your land.

File a suit for fixation of boundary. You can use your title deed for fixation of the boundary case. If the defendant was encroach Your property then you can claim the recovery of possession of the property in the same petition. Also seek injunction against the defendant from their illegal harassment and threat

Hai. the basic defect in such situation is tat people used to think that tge boundary stone determinz the boundary. But its a misconception, the boundary f a plot never changes n it only needs to be distingushed by a properly spotted stone. Then only it becomes a boundary stone. There is a survey plan which accuratly already recorded side measurements n its safly kept with revenue authorities. U may eiher fix ur boundary with d help f taluk revenue authorities. But if there needs a prohibitory order n future protection n also there needs recovery u had to approach the relevant civil court for remedy. Declaratory order along with an injunction decree if needed a fixation of boundary will resolve the matter. But as per ur descriptio i think recovery and consequent injunction will only be necessary. Contact a civil lawer f ur jurisdiction Hope am upto ur query
