Society Nomination and Ownership

Dear Sir, I am hailing from Borivali. My mother-in-law had some internal conflicts with her husband. 4 years back he passed away. He was staying in One flat in borivali. This month we just went to know whereabouts of the flat. We were shocked to know that Society has transferred the flat in the name of His elder brother's daughter, citing nomination form. The Society us refusing to take any letters. We are Hindu by religion. Need your help whether my mother in law can claim ownership of flat ? And to confirm whether society has transferred or not ? Thanks

as your mother in law is the successor of her husband, she is the first and true owner to claim the ownership of the flat.. filing of the nomination form does not entitle the brothers daughter to be the new owner of the property..nomination is a mere process, it does not give ownership rights to the new person in whose name the property is there.

Well, you Mother-in-law can take the objection over such transfer as alleged by you if this is the Self-made Property of your Mother-in-law's Husband & as such, she can challenge this transfer by the way of nomination, by fisrt writing a letter to the Society Secretary to take action against the transferee citing the fake nomination document had been served to the Society. Secondly, if the Secretary doesn't co-operate with you & don't support you to pressurise the transferee to vacate the Home, you can lodge a FIR to dispossess the transferee. Parallely, write a letter to the Registrar of Societies to take action against the Committee Members of the Society by not acting in your favor despite you informing them that the Nomination was fake. Parallely, knock the doors of Co-operative Court, a forum on which the Registrar of Societies presides to handle Society related Matters.
