Society charging maintenance from tenants unfairly, how to stop?

I have flat in  which i have let out the society is collecting Maintenance charges from my tenants .when the society was formed they have taken membership fee & shares amount later on they decided to take corpus fund from all the owners but they have not informed me.latter on they have disconnected water & electricity to my flat due to my dues for corpus fund. I have paid the entire amount of my corpus fund amount but the society people refuse to connect the water and electricity they are demanding penalty for the amount can they demand penalty for corpus fund which they never intimated & what action i can take against them.

File a complaint before the President of the Flat Association. If there is no respondent file a Civil Suit against the Association and take immediately relief (IA) from the court to restore your electricity and water connection. In the suit you can ask for damages also for the inconvenience caused to you. There is no need to pay penalty for corpus fund. Explain this issue to the court.

You must read bye laws of your society. I, think you must have signed on the bye laws at the time of your joining in the society. You must abide by bye laws. You must thoroughly read the bye laws before you sign at time of joining in the society. According to those bye laws of the society all these clauses will be clearly mentioned about the action for non payment of maintenance charges and penalty. If action for non payment of maintenance charges and penalty is not there in the bye laws of the society, you must file a complaint before consumer forum at your place where consumer forum located in your area. Approach Consumer Forum and show the details of bye laws and the action of your committee members and file a complaint for redressal.
