Smoking in the Balcony of an independent house

Hi,
I smoke in my first floor balcony of my independent house . Neighbor, who has a window around 15-20 feet away is making a big issue out of it lately saying that smoking in open area is illegal. Can you please tell whether any action can be taken against me?
I believe, as its my private place, I'm within my rights of smoking.

Dear Sir, who has to say smoking is right?, it is injurious to the health. In pursuance of your balcony of house it may disturb neighbour in this regard, you are having no rights to pollution environment of neighbour he may claim and protest for the same.
