Signed offer letter but didn’t join

A company gave me offer letter, I signed it but couldn’t join due to family reasons, the email had a clause of 70K recovery, but I couldn’t pay due to financial reasons. They filed civil suit against me now I am worried if it will affect my background verification in future companies Will it effect if the case is pending or withdraw?

The offer letter has to be reviewed to understand the basis for claiming damages from you. In general penalty clauses for not joining should be null & void and unenforceable, however in your case we need to determine the claim is it a penalty claim or something else. A litigation existing against you is something which is in public domain. Your future employer can easily find out if there are existing litigation against you or not. Well, you not need to worry at all. Your Ex Employer has filed a Civil Case against you, not a Criminal Case. If a Criminal Case would have been filed against you by lodging FIR, then, it would have certainly impacted your career.

A pending or withdrawn Civil Suit filed by a company against you is unlikely to directly affect your background verification for future employment, most employers conduct background checks focusing on criminal records rather than Civil Cases, Civil Suits, especially those related to employment disputes, are not typically flagged during routine background verifications unless they involve allegations of fraud or misconduct, If the company withdraws the suit, it should have no adverse impact on your background verification since there would no longer be an active dispute.
