school not allowing child admission saying he is under age child

when school says ur children is underage by 3 months and need to be in the same case because of age... is there any such govt. policy ? how to file such cases in courts ? under which catergory such cases comes ?

IN MUMBAI the school education department, through a government resolution (GR), fixed the minimum age for admission to nursery at three years from the 2015-2016 academic year and six years for Class I by 2018-2019.
Several schools currently admit students in nursery at the age of 2.5 years and in Class I at five. So far, there has been no directive from the education department on what will happen to admissions conducted before the GR was issued.
THERE ARE SPECIFIC DIRECTIONS BY EDUCATION DEPARTMENT REGARDING IT.
