can public charity trust sale his agricultural land which is devsthan inam class three. What is procedure, which govt authority sanction permission for sale,can trusty of public charity trust make compromise with tenant in possession suit pending before civil court and accept partly possession in compromise decree, what will be role of charity commissioner in such case.
Yes, the Public Charity Trust can sell his Agricultural Land either to any other Public Charitable Trust working for the cause of securing the livelihood of farmers or to promote agriculture in India or to an Agriculturist.
The Charity Commissioner has to sanction permission for such a sale. Why to compromise with a tenant! Just the trustees need to take signature of the tenant on a Separation/Alienation Deed that willingly & voluntarily, the tenant is alienating/seperating himself with the possession of the Agricultural-Land by getting his due share of fixed proportion/percentage from the Sale-Proceeds i.e whenever, the purchase-price according to the market-value will be realised by the trust.
