Right of step son over step mother's pension.

I am daughter of second wife.my brother age 27 is mentally disabled. Does he have any right to file a case on fisrt wife to claim montly penaion.
even though you are legitimate child you shall can claim right over your father property by filing a petition under section 125 crpc and you can claim a share in pension by filing and getting attachment of the said pension

In general, if there are no children to the first wife, then her paternal side relatives are qualified to claim her pension under succession laws.
Children of second wife are not related to first wife by blood and hence cannot claim pension benefits of first wife.
