Remedy if college/university deny term due to lack of attendance
16-Oct-2023 (In Civil Law)
I am being denied to sit for exams because I have 69 % attendance instead of 75 in part time executive mba course run by a reputed college in Pune, despite giving them a leave application in advance. The TNG notice is given just 2 weeks before exams and out of these 2 weeks, one week college is closed for Diwali. This means they did not leave space for students to present their case properly. I need to bring in stay order to get us allowed for exams as they until now college has allowed exceptions to this 75 % rule in past.
Yes you can approoach court to obtain stay order on implementation of this notice if you have some justifiable
reason for your absence. There are few cases in which such notices have been stayed. There are circumstances wherein students were not able to attend college due to some medical issue or were having some family issue. Court can intervene and grant relief as it affects the student's life.
