Regarding non payment of interest on pending salary

My father had been an employee of Biscomaun, Patna, For non-payment of pending salary he had filed a case and Patna high court gave judgment and directed Biscomaun to pay salary with 6â„…interest upto the date of payment, In the meantime my father got retired and expired, later Biscomaun issued cheque for salary only in my mother's name, on demanding interest Biscomaun showed us a judgment which pardoned the interest payment, please let me know that, can a high court contradict it's own judgment when it has already ordered the proceeding in our favour. Moreover my father was also eligible for 5th pay scale which as on date has not been paid to any of the employee of Biscomaun(Bihar govt)

You can file review petition in the honorable High Court if you are not satisfied with the order in your case. The honorable High Court can change its order or make any sort of modification in the order.

Kindly..give the order details then only any1 can advice you better. Still you can go for contempt of the court in MJC . Regarding your 5th pay scale, you need to file another writ for this fresh issue regarding to your father.

You need to file application for execution of order of high court regarding due amount. Court has already given judgement in your favour then no need of fresh petition. And on the matter of 5th pay scale you can claim via fresh petition because it is different cause of action.
