regarding food franchise termination, as no support provided by them

I had taken a food franchise and paid 2.5 lacs for the same, they committed marketing as well as operational support, but since day 1 we have been suffering due to them. the operational support (cook) provided by them took his salary and ran away after a month. this was 3 months back, till date me and my partner are running our outlet ourselves making the dishes, we just have one helper with us. all the staff provided by them ran away in a day or two. no marketing or promotional actvities were done by them, to boost the sales. our outlet is in kamla nagar,north delhi. even the raw materials supplied to us were at higher costs. Also the email provided to us has been suspended by them. now we want to terminate the agreement and start this outlet by our own name. they have sent us a termination letter which totally supports them. so need advise on the same.

Query perused. I would like to advise you to properly reply to the termination letter. Further issue a legal notice for breach of contract and seek damages. Kindly share the copy of the franchise agreement for our perusal and to enable us to advise you further in this regard. A suit for damages can be filed for breach of contract. You should immediately reply the termination letter countering all their allegations and making your counter allegations. Further you should demand compensation for the losses suffered by you as well as the franchisee amount. You should take services of good lawyer for handling the same.

Hi,

You can file a suit against them for non performance and ask for damages.
I would have to peruse your agreement for the same. But first i would advice you to send a legal notice.
