Property disputed in family, uncle not providing my father's share

There is a property dispute in my family relating to ownership of rice mill and case is in jharkhand high court. My cousin brother has filed case against my uncle's and my father claiming ownership of rice mill . However my uncle holds power of attorney and keeps all income from rice mill without sharing with my father. The cousin brother has also named my father in the case but we don't have any ownership and derive no income from rice mill. Can my father file affidavit in the court and remove his name from the case. What is the solution.

As you have averred in your grievances that Your father have no ownership over Rice Mill and nay getting any income from that Mill but your cousin brother made party in writ to your father without any rhyme and reason. In such a situation you have right to file a petition with affidavit before the JHC, Ranchi for expunging name of your father . Suppose if any interest will create in future over that property then you will not claim after filling this petition before JHC, Ranchi. Prior to file petition you should think whether any right and interest will accrue over that property or not. You have right to omit your father name from that case with the permission of Court..
