Property Bought in court auction document has wrong details

Hi, I am Suresh. I brought a house in court auction while the other party filed insolvency petition. However, the house address is wrongly typed in document as Krishna Colony instead of Krishna Nagar and also the house is situated in 1st lane, but typed as 2nd lane. The mistakes were Colony versus Nagar, and 1st lane verses 2nd lane. Rest of all boundaries, survey number and house numbers were correct. When I checked in earlier sale deeds of 2011, this document also has wrong address whereas the sale deed of 2006 and before documents has correct address. Please suggest the best way to make the correction.

Hello Suresh,

The errors you found out in the Sale Deed can be rectified by executing a supplementary document which is called Correction Deed or Rectification Deed. Both you and the seller need to do the corrections into a duly executed Correction Deed or Rectification Deed. Thereafter, you need to pay the requisite stamp duty in order to get it registered with the jurisdictional sub registrar where the property is situated. There is a minimal stamp duty and registration charges to be paid for the Correction Deed. However, In case, the seller does not agree to such correction or rectification in the sale deed, you can file a suit in the jurisdictional civil court under Section 26 of the Specific Relief Act 1963 and pray for rectification. Dear Client,
You must file an application before the concerned court which orders the registrar to draft sale deed for amending the wrongly typed contents. Then court orders the concerned registrar to draft amended deed and register the same. Thereafter you must keep both original sale deed and amended deed with you for future action.

It look like you did not take any legal advise or opinion from the advocate before purchasing the property in court auction. the information given by you shows that the owners of the property and their pre-owners if any has to execute rectification deed for corrections.
