Procedure to be followed if respondent does not comply with order

If a advocate of respondent fills a undertaking in which they agrees to comply the order passed by highcourt within a certain period but the respondent do not comply the order and give an application of "recall of order" after said period. In such case what we can do??

file an objection in recall of order and also file condemn of court in same the same,
you are must get some remedy in this matter , court will understand the policy of oposit party advocate that why he is filed recall application .

Dear client,
If a advocate agrees to comply the order passed by by any court and did not compley the same. He is responsible for the contempt. As he is counsel of the case or undertaking. You have right to opposed the case before court.

If the respondent does not comply the order passed by high Court you can file a case for contempt of court and he may be punished for non compliance of order.the application for recall of order is not maintainable

Let me tell about the case whether it is pending or disposed of. If the case is pending then you can move an application for hearing. In the other case when the respondeant move the recall application you can raise objection against that recall application.

File objections to the recall application and contest the case. Convince the court that the order has not been completed yet and the contemnor is liable to be hauled up for flying the order passed by the hon'ble court.

Anything which the respondent lawyer give is binding on the respondent because when you engage any advocate for your pleading before any court on your behalf you sign a vakalatnama in which the person authorised the lawyer to do all things which court required from respondent
