Partition Suit Prelim Decree Iam Not A Party To The Collusive Suit
14-Mar-2023 (In Civil Law)
Sir I came to know that a preliminary decree is granted without my knowledge in the partition suit. Iam not a party in the suit but iam a major uds share holder 80% of uds owned by me. The balance 20 % is owned by private limited company managed by family members. They collusively added my 80% and without my knowledge they got preliminery decree hiding the facts. How to proceed further. The judge without seeing the title document based on plaint simply ordered for meets and bounds of the property to be inspected by the advocate commissioner. How to stop this with fastest effect.
Sir, you must file an interim application for impleadment of party to this specific case in which a preliminary decree has been passed. You must talk to a competent lawyer in this regard as soon as possible. By filing this application you shall be impleaded as a competent party to this case, hence, you would stand in a position to contest the case.
