Q: Process to withdraw case filed
For cheque bouncing a case has been filed. First hearing date has been received but yet to happen 1st hearing. Like to withdraw the case, what would be the process for same. Only lawyer who filed the case has to withdraw or as a complainant I can directly do so and the procedure for same. Is it necessary to quote reasons for withdrawl.

You will need to file an application for withdrawal, the application can be filed by the lawyer who filed the case or any other lawyer. The reasons for withdrawal have to be mentioned in the application

The property can be transferred to the wife as she is a class one legal heir and the NOC from the children can be obtained via a affidavit which is stamped by a oath commissioner. Once that is done will need to file case for succession certificate
Q: I Have A Older Cheque And With The Higher Amount. What To Do?
My ex- colleague asked for monetary help of 410000rs which I did by taking a personal loan in 2018 and we agreed that he will pay the emi every month and he gave a cheque of 410000 to me as a security. Now he is now paying the emi from February 2020 till date. After so many reminders, he still not paid the amount. Now I want to post a cheque but the issue is the cheque is 2years old and for the amount of 410000. What can I do? One more thing there is no date mentioned on the cheque. By saying old I meant it is outdated. The format of the cheques is changed.

Dear sir, you can present the cheque for clearing once the cheque gets bounced issue a notice under section 138 and once 30 days gets over and if he still doesn't pay then file 138 complaint thereafter in the court

You can call for another settlement meeting and discuss about the changes that need to be done. Secondly you can pay via cheque or neft in EMI and the same shall be mentioned in the settlement agreement
Q: Can bank manager be a witness in the sworn affidavit
Respected Sir, My question is can the concerned banks involved, their managers can be shown as witnesses in the sworn affidavit filed by the complainant to the court in NI 138 cases, are there any citations or law to show this. Secondly, if there are no stamps of the bank on the returned cheque, can still that be shown as proof of dishonor, any citations to help

Firstly the bank manager can be shown as witnesses in the complaint filed by the Complainant. Secondly bank stamp on the returned cheque is required.Without the original stamp the case is not valid.
