Not able to sell.our share of immovable property

We are Hindus.My father-in.law exeuteda registered WILL passed away In April 2013.my husband is the eldest son. Second brother-in-law is in USA has kept all original documents with him.,postponing the sale of the immovable two properties.3rd son is unmarried and un employed.fourth daughter is married. Not prepared to give our share as per WILL.he says he is the executor of the WILL .o time limit is given for selling the property.can my husband apply for his 25% of property and can he sell his share ? without the consent of other legal heirs,WILL.is not probated

Respected Yes. You can. As you informed that your father in law has executed a will and bequeathed certain portion /object to your husband under a WILL. To that specified subject or portion your husband is entitled. In case if the property is not under as a subject to the WILL then he will get a equal share in the said property. That is 1/4th Share. But the bequeathing is mentioned in the said WILL. As per the same, the subject specified under the said will come to your husband. Without seeking the WILL and its recital it is not possible to answer your question in the specific way. If possible Please contact us or contact any known counsel and discuss.

its own earned from your father in law? he written WILL behalf of whom and what is share he mention in WILL? if it is self earned property WILL can excute or else it is no use. your husband have right to take share from his father property. before should know the exact matter what is in WILL.
