The NOC has to be obtained from the court where the criminal proceedings are pending, in your case, from the Judicial Magistrate First Class (JMFC) or Metropolitan Magistrate Court handling the Domestic Violence case OR from High Court. Practically, your advocate should move a short application requesting permission to renew the passport, stating that there are no travel restrictions imposed and that the renewal is necessary for identification and professional purposes, not for absconding. The High Court typically grants such NOCs within 2–4 weeks upon notice to the prosecution or complainant, while the Magistrate’s court may take 1–2 hearings depending on listing and opposition, making the overall process about two months if diligently pursued.

Hello, By making Appropriate application before the court and you may get the NOC. But in your case you have 2 criminal cases against you so make sure to you draft it carefully in case you have any queries, feel free to reach out.

I can get the NOC from the concerned Magistrate Court where your DV Case has been going on! I will file an appropriate Case to get this NOC as soon as possible in consonance with the concerned provisions of law.

You need to get the NOC from the Bombay High Court, because the 498-A case is stayed there. The Passport Office will only accept the High Court’s permission. Process: File a short application in the High Court (Permission to renew passport). The Court will pass an order saying that the Passport Office may renew your passport. Submit that order to the Passport Office — that works as the NOC. The DV case does not affect your passport.
