You can file a suit for recovery of money before the court of civil judge junior division or senior division of your respective jurisdiction and criminal case may be filed for cheating but you have to establish guilty intention of the accused.

Depending on the type of materials and the amount due you need to consult with an advocate and send him a legal notice first. Then, after his reply (or no reply) we shall proceed to court and get your money.

In my opinion if you have sufficient documental proof in this regard then you can serve a legal notice and then file a civil money recovery suit before the civil court for recovery of your money. And without detail discussion and document review proper consult is not possible.

Since it seems to be a dispute arising out of a contract and action of breach of contract, it should not be regarded as a criminal offence, hence the FIR before the police won't be registered. Rather you write down a letter stating specifically the claim amount and the clear statement of interest upon the principle due which letter should be followed by a Lawyer's Letter, even then if your amount is not paid, you can directly go for a civil suit or for immediate relief you can approach the High Court at Calcutta for winding up (Only if the party you referred is Company), which way many of my clients are benefited.
