Since the local chowki isn't moving, the most effective remedy is to file a complaint to the SSP regarding their inaction while simultaneously having a lawyer send a legal notice to your neighbor demanding the repair costs and the removal of the bumper protector. If that doesn’t work, you can approach the Magistrate under Section 156(3) CrPc to force an FIR for the property damage. You can also file a Writ of Mandamus to compel the police to do their statutory duty, so it’s usually faster.

Your issue is now beyond a simple complaint. If police at chowki level are not acting, you need to escalate legally and create pressure the right way. What offences are involved From your facts, this involves: • Damage to your car → Section 427 IPC • Obstruction / parking interference → public nuisance / wrongful interference • Possible intimidation (if threats involved) Why chowki did nothing Local police often treat parking/property disputes as “civil matter” and avoid registering FIR. But damage to property is a criminal offence, they cannot ignore it. What you should do now (effective steps) 1. File complaint to higher authority (very important) Send written complaint with proof to: • SHO of Police Station • SP / DCP of your district Mention clearly: • Earlier complaint given but no action taken • Car damaged + obstruction created • Request FIR under Section 427 IPC 2. Use online police complaint File complaint on state police portal (UP Police portal if in UP). This creates official digital record which police cannot ignore. 3. Magistrate route (strongest remedy) If police still does not act: File application under Section 156(3) CrPC before Magistrate. Court can: • Order police to register FIR • Start investigation This is the most effective legal pressure. 4. Recovery of damage (important) For compensation: • File civil suit for damages (car repair cost) • Use bills, photos, CCTV as proof 5. Parking space issue If it is: • Your private property → you can seek injunction from civil court • Society/common area → complain to RWA / municipal authority Evidence you must keep • Photos of damage • CCTV (if available) • Repair bills • Complaint copy given earlier • Any witness Reality Until you escalate to SP level or court, police may not act seriously. Once you move legally (156(3)), matter usually progresses fast. If you want, I can: • Draft strong police complaint (SP level) • Prepare 156(3) application • Structure your case for damage recovery + parking rights Do not delay. Property damage cases become weak if not pursued properly.

Dear , regarding your concern about car damage and space encroachment, since the local police have not taken action, the next legal step is to issue a formal Legal Notice for recovery of damages and removal of the obstruction. If they fail to comply, we can file a Civil Suit for compensation and a mandatory injunction in court. To discuss the specific details and evidence for your case, I suggest we schedule an appointment for a legal consultation. Please let me know a convenient time to meet at my office so we can proceed with the necessary legal action to secure your rights.
