Neighbours are using our terrace for storage purpose

If we stay at GF and has one room on rear courtyard. The room is authorized & terrace rights are with GF owner of this newly constructed room as per building bye laws for the society. Still, the FF owner breaks his building wall (at FF level, towards terrace of said room) and fixes one iron door for through fare and keeps house hold items on the terrace. And doesn't allow the owner for service maintenance work. Do we, the GF owner, have right to forcefully throw their household items from terrace and forcefully put one parapet wall in front of door opened by FF owner. Do we require Police presence while using force. Regards.

Hello,
If as per the building bye-laws suggested by you, the ground floor occupant only has the terrace rights ( which is unlike the regular bye-laws which gives the said right/barsati right of the terrace to the top floor occupant) , then you may file a police complaint of trespass and seek their help in getting the unauthorised occupant's occupancy removed from the said portion. Other than that you also have an option of proceeding ahead legally , with a either a suit for permanent injunction , trespass etc. For any further query you may contact me.
