NEET Ordinance quashed existing admission cancelled or not

04-Jul-2023 (In Civil Law)
I would like to know if the neet ordinance is quashed, then would the admissions that have already begun under this ordinance be cancelled? or will it continue as the ordinance was valid till it was quashed? Is there any relief that we can opt for in case such a thing happens?

Hello,
I would like you to know that the Supreme Court has refused to stay the NEET ordinance on 27th May 2016. Now, again the ordinance is challenged by Mr. Anand Rai and Supreme Court will hear the matter on 7th of July 2016.

In my opinion Supreme Court will not quash the ordinance, but if it does then it will be chaotic situation as States in which exams have already been conducted and in the view of the ordinance they were exempted to do so but if Supreme Court does it then a situation will arise as to ; Examination already conducted by the State(s) will become null and void/Cancelled.

If such a situation arises in my opinion Supreme Court will take into consideration; the students who have taken admission in view of the ordinance and have paid the fee.
And remedy one can claim in such a situation is compensation as well as refund of college fee already paid.

Yes there are reliefs available by filling a writ petition in the concerned high court. The admissions already done cannot be denied. The ruling takes affect from the date of quashing.

any ordinance which is quashed stands to be cancelled along with the admissions attached to it. in any case if such happens then you can appeal in the court challenging such order and seek relief to such ordinance.

Respected Sir/Madam,
It depends on grounds of quashing. Before final decision, board will make few grounds/rule then neet ordinance will be quashed. If neet passed such rule where you are not fit it means your admission be cancelled.
