Need guidelines on granted land which comes under PTCL

We purchased land on 1987 from schedule caste person which he got at 1963. But now his son put the case under PTCL. So indians are sentimental on many things,hence this issue becomes for us one type of decies in our life.I am seeking is there any chance to get solution.

The General rule is that Any granted lands to schedule castes and tribes are attracted to ptcl act
But the following are exceptions
1. If a schedule caste person purchased on payment of upset price by means of sale from government then such lands granted on payment of upset price do not attracted ptcl act.
Any inam lands don't attracted ptcl
Any other lands not granted but purchased not attracted ptcl
based on given fact ur case seems to be out of your control and I need further information to find out whether solution available to you.

You need not loose hope merely on the assumption you are going to loose. We need to examine the nature of the grant made as well as terms of grant. Thereafter it has to be seen whether the provisions of PTCL Act are applicable are not.

Dear Sirs,

If the no objection certificate is not issued or other formalities are not followed while selling the land in 1987, then the case under ptcl would be valid. We need to go through entire records tk give proper legal opinion on the same.

The PTCL land is a special grant normally given to the poorest of poor. In order to protect the rights of poor allottee, the patta for the land is given only after about 15 years. There are a lot of strings attached to such land and the right of the poor is almost unalienable. The only solution in your case is to amicably negotiate with the claimant.
