Mutual consent divorce case file misplaced by court what to do
17-Mar-2023 (In Civil Law)
My wife and I had applied for a mutual divorce and the final order has been granted by the court in the Month of September 2016. My lawyer had made an application seeking the copy of the order passed and an order to be sent to the civil marriage registrar to cancel the marriage. The court says that they are unable to find the file. Six months have gone by and am clueless. Please suggest who should I approach and how do I get the file back?
Dear Sir, as an officer of the court and a member of the bar for the past 12+ years i would like to inform you that once proceedings are filed they can never go missing. Pls have your advocate make a complaint before the senior Judge A Court and request for an inquiry. Regards

U first file a detail application before the same court intimating the court that your file is misplaced and to kindly direct the court staff to search the file and see for the response of the court and if within a week's time if still there is no favourable response or if still your file is not traceable then u file a complaint against the concern judge and her office staff before the district court and follow up the same.

It is shocking that the Court cannot trace the file. If the file is disposed usually the same is sent to record section. I think in your case you would have to approach the administrative judge and point out the fact about the missing file. Also since 2016,practice of uploading orders on court website has started, if you are lucky you may find the order on the website as well
