mother and lover harassing sons for dead father's property
05-May-2023 (In Civil Law)
After the father died of cancer in early 2017, the mother had been harassing and torturing her adult sons and her daughter in law to get rid of them. Recently its been found out that the mother had been having an illicit affair with a colleague for the past 15 years. Even the father had confronted her but because of lack of evidence and pressure from her family and close friends and protest by sons, he dropped the allegation. But after his death, her sons found undeniable evidence on their mother's phone which explained her sudden change in behaviour and ill temperament. She is just trying to get rid of the sons and daughter in law from the properties. She also hid all FDs and PFs and other money father left in their name for two years until the sons and her family found out.
She has threatened to file fake cases and also harm them if needed threatening she knows how to "handle them".
How can the sons protect their rights and themselves in the present scenario?
Query perused. In case the property is ancestral it will be divided equally among the legal heirs in accordance with class 1 of the Hindu Succession Act. In the event the property is a self acquired property and your father has left a Will, it will be distributed in accordance with the Will. Hello sir. The issue with your mother is quite unfortunate but there are certain steps you can take to protect your interests. In case your father passed away without a will then your mother and yourself in addition to your brothers have an equal share in your late father's property. You can move civil court for the same.
